Terms of Service

1. Acceptance of Terms

By creating an account or using DiecastPool ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use DiecastPool. By using the Service you represent that you meet this requirement. Users under 18 must have parental or guardian consent.

3. User Accounts

• You are responsible for maintaining the confidentiality of your password.
• You may not share, sell, or transfer your account to another person.
• You must provide accurate and complete information when registering.
• You are responsible for all activity that occurs under your account.

4. Marketplace Rules

When listing items for sale or trade, you agree that:

• You have the legal right to sell or trade the item.
• All listings are for authentic, legitimately sourced die-cast models.
• Listing descriptions and photos accurately represent the item.
• You will fulfill sales within 5 business days of payment confirmation.
• You will not attempt to conduct transactions outside the DiecastPool platform to avoid fees or protections.

5. Prohibited Items & Conduct

The following are strictly prohibited:

• Counterfeit, replica, or unlicensed items.
• Stolen merchandise.
• Harassment, threats, or abuse of other users.
• Manipulating bids, reviews, or reputation scores.
• Automated scraping or bot access to the platform.
• Circumventing seller verification requirements.

Violations may result in immediate account suspension or permanent ban.

6. Fees & Payments

DiecastPool currently operates without listing fees during its early-access period. Future fee schedules will be announced with at least 30 days' notice. Payments are processed via PayPal; DiecastPool does not store payment card data.

7. Disputes Between Users

DiecastPool provides messaging and order tracking tools to facilitate dispute resolution, but is not responsible for the outcome of transactions between users. We may mediate in good faith but make no guarantees. Buyers are encouraged to confirm item condition before marking an order complete.

8. Intellectual Property

You retain ownership of photos and content you upload. By uploading, you grant DiecastPool a worldwide, royalty-free licence to display and serve that content in connection with the Service. DiecastPool is not affiliated with or endorsed by any die-cast brand.

9. Limitation of Liability

DiecastPool is provided "as is" without warranties of any kind. To the fullest extent permitted by law, DiecastPool shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service, including losses arising from transactions between users.

10. Termination

We may suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time by contacting support. Termination does not affect obligations arising from completed transactions.

11. Changes to Terms

We may update these Terms from time to time. We will notify you by email and update the "Last updated" date. Continued use after changes takes effect constitutes acceptance.

12. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation or, if necessary, binding arbitration in accordance with applicable rules.
